NEGLIGENT NON-DISCLOSURE OF WATER SUPPLY—Simi Valley (November 2009)

CIV 234437, Judith Bliszcz et al. v. Elinor Goldberg et al., filed 6/17/05

Plaintiff's Attorney:   Arthur Carvalho Jr.

Verdict:  $1,846,108.00                                Dept S-5

Plaintiffs purchased acreage near Fillmore for future farming operations including oranges, lavender, and raising animals for meat, milk and cheese.  Plaintiffs alleged Defendants failed to disclose water supplies had been previously cut off on property and therefore were inadequate.  Jury awarded $300,000.00 difference in fair market value of property,  $1,525,108.00 lost profits from farming operations and $21,000.00 costs for temporary water supplies.  Memo of costs totaled $14,684.21.  Defendants asserted adequate disclosures were made, no farming operations history for lost profits.  Defendant moved for new trial and judgment notwithstanding verdict based on inconsistent verdicts and insufficient evidence which was denied in June, 2010. Defendants’ appeal of verdict pending.
