Plaintiffs alleged that Defendants, cross-street neighbors, obstructed their ocean views by not cutting hedges according to the 2002 city View Ordinance. Defendants were willing to trim their hedges in a multi-tiered manner, but not to the level demanded by Plaintiffs, and defended on ground of laches, unclean hands and that the ordinance could not be applied retroactively. Court denied Plaintiffs' request but did order maintenance based on Defendant’s requested levels.
