Plaintiff sued her dentist and otolaryngology surgeon for alleged misdiagnosis of a cancer condition on the underside of her tongue. Plaintiff’s husband, an internist, referred Plaintiff  for an examination of sores by Defendant Feinfield in 2005, who allegedly  found nothing alarming and recommended prednisone.  After nearly eighteen months, husband again referred wife to Defendant Feinfield for another exam, this time Defendant finding ulcers present and recommending oral rinses. During the eighteen-month period Plaintiff was also examined by her primary care physician with no complaints about her tongue condition. When no improvement occurred, a biopsy was done in 2007, revealing the cancer condition.  Surgery was performed to remove structures on the tongue with chemotherapy and radiation. Plaintiff also alleged dentist Klieger, who had treated Plaintiff since 2004, likewise misdiagnosed her condition. Defendant Kleiger claimed Plaintiff never complained of any lesions on her tongue area during the time he provided dental treatment. Both physicians claimed their treatment did not fall below the standard of care.
