Plaintiff sustained a torn rotator cuff injury while using Defendants manufacturer’s push up exercise equipment. On the strict liability claim the jury found that the product had known potential risks at the time of manufacturing but the equipment did not fail to perform safely as a consumer would expect, and the known potential risks did not present a substantial danger. On the negligence claim, the jury found Defendants’ negligent but their negligence was not a substantial factor in causing harm to Plaintiff. Plaintiff waived his post-trial remedies for new trial and his motion to tax Defendant’s costs ($62,716.00), intending to appeal the decision.
