Plaintiff was bit as he walked his dog by Defendant Cervantes home. Defendant Anaya left her dog for a week to be cared for by Defendant Cervantes. Somehow, the dog left the Cervantes yard, encountered the Hernandez dog and Plaintiff was injured trying to separate the animals. Defendant Anaya never told Defendant Cervantes the dog had bitten anyone or attacked another dog. Summary Adjudication previously granted for Defendant Cervantes on Strict Liability and Nuisance. Non-suit granted on absence of evidence that Defendant Cervantes knew of the dog’s dangerous propensities.
