Plaintiffs husband and wife were east bound on FWY 118 near Sycamore Drive, when they avoided Defendant’s car as it changed lanes near their course of travel. Wife settled with Defendant’s insurance carrier and also received underinsured motorist payments. Husband, the passenger, maintained his action under limited jurisdiction case value. Jury found Defendant negligent but not a substantial factor for injuries. Post arbitration request for Trial de Novo filed by Defendant.  Plaintiff’s Motion to Tax Costs denied.
