Plaintiff, who was driving with his 7 year old daughter on Olsen Rd. in Thousand Oaks, saw a cigarette tossed from Defendant’s car and gestured to Defendants while speaking. Believing Plaintiff’s cell phone was a gun, Defendant passenger shot at Plaintiff’s car, intending to shoot out the tires. No one was hit by the bullets that struck Plaintiff’s car. Each Plaintiff was awarded $100,000.00 compensatory damages and $50,000.00 punitive damages. Defendant passenger had previously pled guilty to discharging a firearm at an occupied motor vehicle and was sentenced to a 3 year prison term.
