Eighty-three-year-old Plaintiff was a passenger in the middle vehicle that was rendered totaled in a three vehicle rear-end accident, in which she sustained soft tissue injuries to her neck and back. She received physical therapy treatment totaling $15,873.00 that was interrupted by a 17-month gap allegedly due to receiving treatment for a pre-accident colon cancer condition. After the 17-month break in physical therapy treatment, Plaintiff received a physician’s recommendation for future epidural injections for the remainder of her life ($180,000.00) for neck and back pain, based on MRI findings revealing fractures in the sacral area. Defendants maintained the impact was minor, as their vehicle sustained little if any damage, that Plaintiff had pre-accident history of back pain, and their radiologist at trial claimed the pre and post-accident MRI’s showed no change in her condition warranting epidural injections. The jury awarded past medical expenses of $10,997.21, future medical expenses of $18,000.00, and zero dollars for past and future pain and suffering. Defendant’s last offer pre-trial was $30,000.00
