Plaintiff was a rear-seat passenger in a vehicle hit from behind, forcing a second impact with a vehicle stopped in front.  Injuries included initial stomach pain with neck and back pain and dizziness that later developed into hip, knee and disc condition, as well as brain injury eventually rendering Plaintiff unable to work or engage in any social or recreational activities. Defendant admitted fault but asserted that the accident could have caused nothing more than minor soft tissue injuries.  Plaintiff's motion for new trial or in the alternative an additur was denied. Defendant was awarded costs of $127,691.00 despite Plaintiff's objections that Defendant's 998 offer to compromise was defective.  This issue along with evidentiary matters are currently being appealed by Plaintiff.
