While Plaintiff was riding his bicycle up Carrillo Street from the downtown area heading toward the Mesa region of Santa Barbara, Defendant crossed into the bike lane and struck Plaintiff, resulting in a left hip fracture, closed head injuries, left knee non-displaced fracture, visual disturbances, loss of smell, reduced sense of taste and cognitive impairments. Defendant admitted liability but disputed full extent of economic losses. In closing argument, Plaintiff requested in excess of $3,000.000.00 and Defendant suggested a verdict value near $250,000.00. Jury awarded $106,899.00 past medical expenses (later reduced post verdict to $67,118.07 by court order on Defendant's motion for a Hanif reduction; Plaintiff stipulated to the reduction and did not oppose the motion), $16,971.00 past loss of earnings, $142,434.00 future medical expenses, $3,333.00 future loss of earnings, $75,000.00 past general damages and $250,000.00 future general damages. Lowest demand pre-trial $2,250,000.00 and highest offer $300,000.00. Plaintiff’s motion for additur of non-economic damages was denied.
