# 1305245, Lyn DelMastro v. Quest Diagnotics, UCSF Medical Center, et al.

Filed 1/27/09

Plaintiff's Attorney: Eugene Locken

Defendants Attorneys: Michael D. Gonzalez, Quest Diagnostic

Marc D. Zimmerman, UCSF Medical Center

Peter G. Bertling, Dr. Charles Kass

Verdict: Defense for Quest Diagnostics                              Dept. 3

Confidential Settlement for other Defendants

Plaintiff alleged in July 2004 she was misdiagnosed with chronic myelogenous leukemia (CML) and that Defendants negligently failed to diagnose polycythemia vera (PV), both blood clotting disorder diseases.  Separate from these conditions, Plaintiff also had factor V Leiden disorder and Budd-Chiari syndrome, also both clotting conditions.  Defendants denied that the medical treatment provided fell below the standard of care, and maintained that Plaintiff had a long history of medical and psychological problems.  Jury determined no liability for Quest Diagnostics; hung jury on remaining Defendants.  Confidential settlement made with Plaintiff and remaining Defendants post-verdict.
