Plaintiff granted an easement to Defendants for installation of a commercial terminal pad to be used as a communications facility. The installation by Defendants did not conform to the schematic plans and elevations for the property, located in the Heritage Ranch area of San Luis Obispo.  Based on Plaintiff’s 4th amended complaint, the jury awarded damages for Defendant’s negligence for the cost of the re-installation of the terminal pad, and attributed 83% fault to Defendants and 17% fault to Plaintiff. Defendants filed a motion for new trial and motion for judgment notwithstanding the verdict. Results pending.
