Petitioner, first cousin to Decedent (who was never married and without children) contested subsequent will under Probate Code 21350 based on lack of capacity and undue influence. Respondent was a care giver who met Decedent at a residential care facility when he was admitted due to injuries from a fall, already suffering from effects of Alzheimer disease. Respondent began to open mail of Decedent and realizing his wealth (estate valued at $7-8 million) transferred nearly one million dollars to family members and others. Petitioner arranged for conservatorship upon learning of transfers. Respondent claimed Decedent had capacity and there was no undue influence in second will which would have left entire estate to Respondent. First will left bequests to 3 cousins of Decedent for $100,000.00 each and remainder to Calif. Institute of Technology.
