Plaintiff was hired by Defendants homeowner's insurance carrier to represent Defendants in an underlying easement dispute. When coverage was terminated Plaintiffs law firm unsuccessfully moved to be relieved as counsel. Plaintiffs claimed it advised Defendants of their duty to pay fees both before and after motion was denied. Defendants believed insurance company remained responsible for fees and alleged they were never advised by Plaintiffs of changed responsibility for payment of fees.
