Plaintiff worked from 1983 until March 2008 in various positions for Defendant company, a large manufacturer of PVC component parts for pools and spas. Plaintiff alleged discrimination, retaliation and failure to accommodate for firing him because of a medical disability (fainting episodes).  Plaintiff further claimed that Defendant was aware of the medical disability and fired him because of the condition.  Defendant claimed they never knew of any medical disability at any time, and maintained the disability was all feigned by Plaintiff.  Defendant contended Plaintiff’s termination was based on insubordination, repeatedly failing to follow company policies, and failing to follow instructions from supervisors.  Defendant claimed that Plaintiff first informed his employers of the alleged disability after he was terminated.  Jury returned a defense verdict.  Post-trial, Defendant filed a cost memo of $8,222.02.
