Plaintiff worked as farm equipment maintenance at California Polytechnic State University, San Luis Obispo from 2005 until 2007, when he resigned while under investigation for financial misappropriation and dishonesty, resulting in a confidential settlement with the district attorney and payment of restitution.  Plaintiff alleged he left his position because he was subjected to discrimination, retaliation and harassment based on his Mexican/American racial status.  Defendants denied all allegations and claimed that termination of employment was based on Plaintiff’s misconduct and voluntary resignation.  Court denied defense motions for nonsuit and directed verdict.  Jury returned defense verdict.  Plaintiff's motion for new trial based on claims of jury instruction and verdict form error related to the criminal investigation of Plaintiff during his employment at Cal Poly was denied.  Defendants requested costs totaling $36,220.04.
