Plaintiff Deem, supervisor of store tire center, and a co-employee sued for sexual harassment, negligent and intentional infliction of emotional distress based on co-employee Defendant’s conduct including his remarks that Plaintiff Deem had sexual intercourse with co-employees, displaying of sex images, bringing inappropriate magazines to work, and making of jokes and comments regarding sex. Plaintiffs alleged notice was provided to employer. Plaintiff Duarte’s action was dismissed prior to trial. Defendants filed cost memo 5 months after Duarte dismissal. Court granted Plaintiff Duarte’s Motion to Strike costs. Case bifurcated on punitive damages.
