Plaintiff sued on breach of contract and open book account after personally guarantying a debt of approximately $525,000 to fund a company selling a small trash compactor product for recycling, known as the Ecopod. Plaintiff was to be reimbursed in specified installments 50%. Plaintiff claimed Defendant defaulted on his obligation to reimburse. Defendant cross-complained for equitable indemnity claiming Plaintiff improperly seized assets, misrepresented and concealed facts regarding the loan, engaged in self-dealing and mismanaged the corporation. Court decision after jury trial denied cross-complaint relief.
