Plaintiff sued for Breach of Contract and Fraud over the sale of Defendant’s partnership interest in a carpet business claiming Defendant misled Plaintiff about the value of the business, that Defendant intended to compete with Plaintiff, that Plaintiff did not have access to financial records, that Defendant breached his fiduciary duty regarding the sale, and that Defendant had a duty to transfer his Contractor’s license to the business. Defendant cross-complained for monies owing on the promissory note. Court awarded Defendant $201,980.00 including $28,400.00 for attorney’s fees. Verdict affirmed on Plaintiff’s appeal.
