# 00364134, Rafael Garcia v. Carl Goer, filed 12/14/09

Plaintiff's Attorney:  Richard A. Fisher

Settlement:  $300,000.00

Plaintiff, a groundskeeper at a golf course, was struck in the leg by a stake when Defendant, operating a golf cart, drove over a perimeter rope attached to the stake, lifting it  out of the ground and sending it flying into Plaintiff's leg, causing a fracture.  Treatment included placement of a rod into Plaintiff's leg.  Defendant claimed the rope was inappropriately placed and a wider path should have been made for use by the golf carts . Past medicals, provided by workers compensation totaled $39,000.00 with loss of earnings totaling $50,000.00.
