Plaintiff was a pedestrian walking adjacent to a local Santa Barbara office parking lot when she observed Defendant’s vehicle strike another parked car and proceed to leave the scene. Plaintiff waved at Defendant as he proceeded to exit the parking lot to get his attention, and alleged Defendant then turned his vehicle toward Plaintiff, and struck her, and proceeded to leave the scene again. Plaintiff tumbled off the vehicle, struck her head on the asphalt surface sustaining multiple hemorrhages, and a grade-three concussion, impacting neurobehavioral abilities to see, hear, taste, smell, memory, read, walk, talk and recall. Medical expenses totaled approx. $77,443.83; and loss of earnings $21,432.00. Plaintiff’s husband made a loss of consortium claim. Settlement was paid from auto and excess insurance policies.
